and conditions listed below which regulates the use of the website
and constitutes the basis of the relationship between you and us
which is for the provision of quotes only.
1. USE OF THE WEBSITE
The use of this website “www.247spares.co.uk” (The website) is based strictly on the terms & conditions
set out below. Thus if you “DO NOT” agree to
these terms and conditions, you MUST cease all use of the Website
immediately. You may print and keep a copy of these terms, for
your personal reference as they form a legal agreement between you
and us which can only be modified with our consent.
2. THE PURPOSE OF THE WEBSITE
We operate one of the largest UK spare parts website used by
hundreds of car dismantlers / recyclers and motor trade suppliers
across the country that are willing and able to provide you with
free quotations for parts they may stock that you seek quotes
for.
3. GENERAL

247 Spares is a free
website subject to registration which provides a “Quote
Only” service for new and used vehicle parts across the
United Kingdom subject to;
- You completing a parts request form.
-
Upon completing a
part request form, you agree to provide basic details of your
vehicle make, model, year, engine capacity, part(s) requested and
or OEM numbers, descriptions and any additional information that
will assist in identifying the correct part required.

Provision of your
personal contact details comprising of your names, postal code,
email address, fax, mobile and any other contact telephone
numbers.
-
If you opt to receive
notification of any quotes by SMS text message we will require you
to set up the service by ;
- Replying with the
word “Parts” to the short code “80008” to
activate the service.
- Please note there is a one off charge of £1.50 to activate
this service, plus the cost of a single network message in response
to our free activation text.
- Activating this service does not guarantee you will always receive text quotes as
the £1.50 charge is only to activate the service on a UK
registered mobile phone number.
- Once the service has
been successfully activated, all “TEXT QUOTES” will be
sent FREE of charge to the mobile phone used to activate the
service, for each reference number provided.
- The number of quotes sent is “unlimited”, but subject to a fair use policy.
- By completing the
parts request form, you give consent to allow us to forward all the
information you have registered and provided on the website, to
spare parts suppliers for the purpose of obtaining comparative
quotes in response to your inquiry.
- We deem a quote to
have been provided only when we have communicated this fact to you,
with a reference number and a pin.
- All quotes and
references will be stored on our website for a period of thirty
days for your convenience and retrieval, from the date it is first
quoted.
- By providing comparative quotes in response to your inquiry, we do not guarantee that the parts are
reserved specifically for you, because spare parts suppliers deal with matters on a first come first served
basis.
4. COMMUNICATION
We use several means of communication to facilitate the forwarding
of the quote(s) you have requested which comprises of:

Emails
- Where a valid email address is provided, the first email received from us is a parts request
confirmation email which contains information about the inquiry you have submitted to the system,
which contains your part reference number, login pin number and general advice about using our
service.

Email notification of quotes requested will contain the following information only:
- The trading name of the supplier
- Their location
- The price quoted by the supplier
- The condition of the part i.e. used, new or reconditioned.
- Where applicable the carriage costs for the part and any other additional notes attached
to the part by the supplier.

Text messaging
Text messaging is a facility by which SMS texts are sent to your mobile phone handset which must be
either on a contract or pay as you go tariff and registered in the United Kingdom. They consist of two
types for our purposes:
- SMS Text Alerts: If you’re mobile number is correct & valid we may send an SMS alert
free of charge to your handset. The message will contain a reference number and pin so that you can
login to our customer login area to retrieve your quote(s). This is essentially a courtesy SMS from
us sent to you and its ‘only purpose is to inform you that quote(s) are available to be
retrieved online.
- Text A Quote Service: This is a communication option which you must activate of your own accord,
by selecting “yes” on the online parts request form. There is a one off charge of
£1.50 for the activation of this service.
- Activation will only take place after you receive a free SMS text from us, which requires you
to reply with the word “Parts” to 80008.

Please note that one SMS Text message is limited to 160 characters and as a result we will only
provide the following information:
- The cost of the part.
- The condition of the part.
- A contact telephone number for the supplier.
- And or a request for further information from a supplier.
- If you wish to view the quote in further detail as opposed to being limited to the information
in a text you will need to revert to the customer login area to view full details of quotes, which
will be held on the website for a period of 30 days from the date it was posted.
- Please note that we do not guarantee that you will receive a quote as this is outside our
control.
Please note that there are no re-occurring charges for the text a quote service other than the
£1.50 activation fee, plus one network text message. This charge is however non refundable.

Customer login area
This is a free utility hosted by 247spares.co.uk on its website to be used for the sole purpose of
retrieving quote(s) only.
- To use this facility you need to enter your reference and pin number which is generated on
screen and sent to you by email and courtesy text alert.
- Quotes can only be retrieved if a supplier has responded to you, and we have alerted you to this
fact via email or SMS alert.

Suppliers' contact details
-
All notification emails and quotes retrieved from the customer login area will contain a
supplier's contact details provided to us, which may include:
- The supplier's trading name.
- The supplier's trading location.
- The supplier's contact telephone number.
- The supplier's facsimile or email address where provided.

Contact telephone numbers will consist of ;
- Numbers beginning with the prefix 070 are described as “Follow me numbers”.
These numbers are provided by third party telecoms to facilitate communication with a spare
parts supplier, as many of them may have multiple locations and telephone numbers. This
service allows you to connect to the supplier directly regardless of location.
- All contact numbers beginning with the prefix “070” have a call back and
voicemail facility enabled which you can use at any time by selecting the appropriate
option from your handset and then following the simple instructions to leave a voicemail
message or a contact telephone number to be called back on.
- We recommend you use a landline to make calls to these numbers as some mobile networks
charge higher rates.
- This service exists to allow you leave voicemail and a contact telephone number for
supplier(s) if you are unable to establish contact in the first instance. We reserve the
right to change these numbers from time to time.
- Numbers beginning with the prefix 080 are described as “Non Geographical
numbers” They may be located anywhere in the country.
- Numbers beginning with the prefixes 0800 and 0500 are described as “Free Phone
numbers” and may also be located anywhere in the country.
Please note that all communication sent to you through our website
carries the “247spares” logo to ensure that you are
fully aware that the message has passed through our website and to
ultimately protect your privacy.
However we do not accept responsibility for the accuracy or the
contents of the quotes provided which are generated by a variety of
spare parts suppliers across the Country.
5. THE AGREEMENT BETWEEN YOU AND US
- The agreement between you and us is for the provision of “quotes” only for spare parts for
your personal comparative purposes.
- You accept that the communication of any quotes to you by us is provided subject to your initial request
and the provision of all required information.
- By using the website and our service, you acknowledge and accept that all information provided in the
form of quotes, arises at your behest by the completion of our online parts request form with your personal
contact and vehicle details.
- 247spares.co.uk does not deal with any form of consumer selling as we do not sell, exchange, stock or
deliver goods of any sort. We merely provide a quote service for spare parts which arises at your
request.
- By providing quotes for comparative purposes to you 247spares.co.uk merely acts as a medium for
disseminating quotes for a number of spare part providers across the United Kingdom.
- None of the quotes provided through this website constitutes an offer, invitation to treat or a counter
offer of any sort and neither does it form the basis for any contracts at all. They are merely quotes
provided subject to your request.
- By communicating quotes raised at your request you accept that we have completed the agreement between us
which is a quote for spare parts only, when they are sent to you by the communication means provided.
- We do not accept any responsibility for errors entered on the part request form as it is your sole
responsibility to ensure that all appropriate data is entered correctly and appropriately reviewed before
submitting it to us.
- By submitting your information to us you accept that your request is for quotes only and that this does
not form or constitute a Contract for the supply of goods or services on our part.
- You also accept that by responding to your request for comparative quotes we do not constitute a third
party or act as agent (implied or otherwise) for the purposes of any contract(s) to be concluded between you
and any supplier.
- You acknowledge that we do not sell any parts for any vehicle, and accept that our site is a venue to
allow anyone from anywhere at any time to request a quote for parts for comparative purposes only.
- You accept that at no point do we have possession of any parts, inventory or control the contents of any
quotes received.
- You accept that we do not review quotes or their contents and are not involved in any transactions
between buyers and sellers, or any contract concluded, if the quote is pursued further by you.
- You accept that we do not have any control or guarantee over the quality of parts, their safety, and the
truth or accuracy of quotes received or forwarded to you from suppliers.
- You must be 18 years of age or older to use this website.
6. ACCURACY OF INFORMATION
www.247spares.co.uk & www.247spares.com; 247 Spares Network, 247 Spares are all trading names of Citynet
Datacom Ltd, PO BOX 4270 London W1A 7WP (‘247 Spares’, ‘we’, ‘our’, ‘us’)
do our best to ensure that all information found on the Website is accurate and correct to the best of our
ability.
If you find any information on the Website which is inaccurate or wrong please let us know and we will
endeavor to correct it, where we agree, as soon as is reasonably practical. Important our Warranties,
Liabilities and Disclaimers are generally are set out in clauses 10, 11 and 12 below.
7. INFORMATION AND LINKS TO OTHER WEBSITES
- All information made available to you through our Website (”the information”) is provided
subject to your request for comparative quotes for new and used vehicle spare parts, which are derived from a
variety of spare parts suppliers across the Country.
- Consequently whilst we agree to use reasonable care in all our endeavors regarding our Website we do not
warrant that the information provided by spare parts suppliers, which is forwarded to you as quotes is true,
correct or complete and further we exclude all the conditions, terms warranties both express and implied,
statutory or otherwise in respect of the provision of quotes as requested by you to the fullest extent
permitted by law.
- We make no representations whatsoever about any other websites which you may access through our Website
or which may link to our Website.
- When you access any other website you understand that it is independent from us and that we have no
control over the content or availability of that website. In addition, a link to any other website does not
mean that we endorse or accept any responsibility for the content, or the use of, such a website and we shall
not be liable for any loss or damage caused or alleged to be caused by or in connection with use of or
reliance on any content, goods or services available on or through any other website or resource.
- Any concerns regarding any external link should be directed to its website administrator or web master.
- You must not use our Website in any way that breaches the terms of any current legislation or in any way
that is deemed unlawful.
- You must not do anything which breaches the security of our Website as we may pursue you for all
consequential loss or damages suffered as a result of your actions.

8. PROVISIONS OF SERVICE
Access to the website is provided free of charge but subject to the terms and conditions contained in this
agreement.
- We will endeavor to ensure that access to the website is available 24 hours a day however we do not
accept any liability for our failure to do so, for events arising from acts of God, terrorism or warfare
that is beyond our control.
- We may for operational reasons, and at our sole discretion change the domain names which the Website is
made available under; or suspend the provision of the Website for cyclical maintenance or because of a fault,
without prior notice.
- In certain circumstances we may be prevented or hindered in providing you with access to the Website or
communicating with you through the website due to circumstances beyond our control.
- Such circumstances, shall include but not be limited to acts of God, fire, storms, power shortages,
issues with our Bank, Internet Service Provider, Hosting Provider, which affect connections to the Internet
as well as server crashes, deletion, corruption or loss of data, acts of war and terrorism.
- In the unfortunate event of such circumstances arising, we shall use our best endeavors to mitigate any
impact caused by carrying out all and any obligations or duties in other ways available to us which are
reasonable and practical at the time.

new and used parts to the best of our abilities, and this shall include liaising with a variety of
spare parts suppliers across the country, our successors (including the purchaser of the whole or
part of our business), associates, sub-contractors and other authorized third parties to contact
you.
- You may liaise with us in writing to formally request disclosure about the data we hold on you
under the Data Protection Act 1998 by writing to the Data Controller at Citynet Datacom Ltd, PO BOX
4270 London W1A 7WP, along with a cheque to cover our reasonable processing charges as provided for
by law.
- By providing personal information and requesting a quote for spare parts on the website, you
agree that we may collect information about your vehicle and inquiry for the purposes of collating
information to enable us send you future offers that arise from time to time.
- By using our website to request quotes for spare parts you agree to ensure that all pertinent information
pertaining to your identity, vehicle, model, parts requested and other vital information shall be provided
correctly and that where errors occur no fault shall lie with us.

You are responsible
for ensuring that the vehicle registration mark interface correctly
displays your vehicle registration, before submitting your request
as this is a service provided by a third party, which we have no
control over and do not accept any responsibility for, regarding
its contents.
10. WARRANTIES AND GUARANTEES

We do not offer
Warranties or Guarantees of any sort as we do not deal in the sale
or supply of any vehicle spare parts and neither are we a party to
any contracts to supply them to you.

We merely provide
quotes for your comparative purposes and the moment that they are
received our agreement with you is concluded.

We do not promote,
warrant, endorse or guarantee products of any manufacturer or
franchisee.
11. LIMITATION OF LIABILITY

To the fullest extent
permitted by law, we shall have no liability whether in contract,
tort or otherwise for; any loss or damage suffered to goods (as we
have no contractual agreement with you for the sale and supply of
any goods whatsoever); Direct, indirect, incidental or
consequential damages including loss of profit whether caused by
the supply of the services we provide through our Website or
information set out on our Website.

Notwithstanding the foregoing, nothing in
these terms and conditions is intended to limit any rights you may have as a consumer,
under applicable law or other statutory rights that may not be
excluded nor in any way do we seek to exclude or limit our
liability to you for death or personal injury.

You agree that the
247 spares acts as the provider of comparative quotes only subject
to your written request and confirm that you will take all
appropriate measures and advice prior to acting on any quote
received from a supplier to ensure that the goods involved are fit
for your purposes, meet what you consider to be a satisfactory
merchantable quality and above all leave you in a fitting and
satisfactory position ensuring that you are fully aware of all the
conditions involved as a buyer in your own name.

You and us do not
have a contract for the sale and supply of any goods and services
apart from the provision of spare part quotes for comparative
purposes subject to your request. We are thus not a third party,
agent (implied and otherwise) to any contract made with the
supplier of spare parts and neither do we have any third party
rights accruing under any contract, whatsoever.

In light of the provisions of Clause 11 (iv)
above, you accept and confirm that where you act as a buyer
for spare parts in your
personal or professional capacity, it is your responsibility to
ensure that all appropriate steps are taken to ensure that you are
aware and satisfied with the quality of any goods involved as well
as the terms of business, which do not and have never included us
as a party.

It is your responsibility to liaise with the spare
parts supplier in a timely manner using the reference and details
we have included in the quote, if you wish to pursue a quote
further.

As the nature of this agreement is for a quote
only service, we are not responsible for guaranteeing the provision
of spare parts, their sale or whether a supplier will even sell
them to you, as this falls outside our ability and
control.

In certain circumstances suppliers may choose to
call you directly via the telephone to request further information
or to give you a verbal quote. In such circumstances it is your
responsibility to ensure that the supplier confirms their identity
and your unique reference number to you, before entering into any
specific discussions, which will remain outside our remit as we are
not a party to it and, cannot be held liable for any losses or
damage which may occur, as a result of discussions held with the
supplier.

We will never call you regarding any inquiries
about a quote or spare parts as we do not sell any goods. We may
however liaise with you to clarify information you have submitted
on the website, or to discuss a complaint, at our discretion, but
will first identify ourselves to you before proceeding.
12. DISCLAIMER

We do not promote,
endorse, guarantee or recommend any manufacturers products and
neither are we affiliated with any companies.

In providing
comparative quotes, we do not guarantee the availability of any
parts, or that the supplier will sell them to you or that stock
will be held to your specific inquiry.

We do not guarantee
the accuracy of any information received in quotes as these come
directly to you from the supplier and is therefore out of our
control. It is therefore your responsibility to ensure that all the
information contained in the quote is the same meets your
requirements, as we will not be liable for any losses or damage
which may occur.

We do not review any
quotes received for accuracy or content and we do not interfere or
amend them under any circumstance as they are sent directly to you
from the supplier, and remain outside our control. We will
therefore not be liable for any losses or damage that may
occur.

We do not guarantee
that by using our website you will receive any quotations, this is
outside our control and completely dependant on stock levels held
by suppliers at the time your make you enquiry for quotations.
13. COPYRIGHT AND TRADEMARK©

You acknowledge that
all intellectual property rights in and to our Website is and shall
remain the exclusive property of 247 Spares.

The 247 Spares Logo
is our registered trade mark and exclusive property and must not be
used or infringed in any way as this will result in litigation and
an account for any profit generated without our prior
authorization.
14. MISCELLANEOUS
If
any provision or terms set out above shall become or be declared
illegal, invalid, or unenforceable for any reason whatsoever, such
term or provision shall be excluded from the other terms and
provisions, which will still be construed as all the terms and
conditions governing this agreement for the provision of
quotes.
Service of any notice under this Agreement shall be deemed to have
been duly given if it shall have been left at or sent by post to us
at our registered office or in the case of a notice sent to you at
an address which you have provided us or such address that we can
establish from any details that you provide.
Any
delay or failure by us to exercise a right or remedy shall not
constitute a waiver of such rights or remedies and shall in no way
affect our right later to exercise them.
15. LAW

Any person who is not
party to these terms shall have no right under the Contracts
(Rights of Third Parties) Act 1999 to enforce any terms set out
herein. This clause does not affect any right or remedy of any
person which exists or is available otherwise than pursuant to that
Act.

This agreement shall
be governed by and construed in accordance with the laws of England
and Wales and you hereby agree to submit to the exclusive
jurisdiction of the English courts.
We reserve the right to change these terms and conditions from time
to time at our discretion, which you will be notified of on our
